Explanation/Current Listing of Ordinances for Calendar Year 2009
Background
The Master Ordinance serves as a repository for actions taken by the Board of Directors (Board) during a calendar year to: 1) establish tolls, service charges and transit fares; and, 2) prescribe rules and regulations governing use of the Golden Gate Bridge, its approaches and its facilities, including the District’s bus and ferry systems. The Board, at its meeting of January 26, 2001, by Resolution No. 2001-015, approved a new annual numbering and recodification system for ordinances and the Master Ordinance. With this system, each individual ordinance adopted during the calendar year with continuing validity is incorporated into a newly adopted Master Ordinance in the subsequent year. Each annual Master Ordinance includes an Appendix that indexes all of the individual ordinances adopted throughout the current calendar year. The Appendix also includes a historical index of ordinances adopted since this system began in 2001. Adopting the Master Ordinance on an annual basis makes this document a more useful resource to members of the Board, staff and the public, as well as allows the District to more efficiently administer the ordinance system.
Summary
Master Ordinance 2009 updates the District’s codified set of ordinances. It updates the transit tariff schedules to include the annual 5% increase provided for in the Five-Year Transit Fare Program that the Board approved on March 24, 2006. In addition, it incorporates the following four ordinances passed by the Board in 2008:
- Ordinance No. 2008-01, Approve an Increase in the 2008 Special Event Ferry Fare Between the Larkspur Ferry Terminal and AT&T Park;
- Ordinance No. 2008-02, Approve a Base Toll Increase on the Golden Gate Bridge;
- Ordinance No. 2008-03, Approve Amendments to Ordinance No. 2008-02, An Ordinance to Amend Master Ordinance 2008, As Amended, to Revise Bridge Tolls;
- Ordinance No. 2008-04, Approve Transition to TransLink® as the Sole Method of Receiving Golden Gate Ferry Frequent Rider Discounts.
As a housekeeping effort, Master Ordinance 2009 was also revised to include various non-substantive, administrative changes proposed by staff to better align fare collection procedures with Board policy, as follows:
- Table of Contents – Incorporate proposed changes;
- Section I.A – General Provisions, Definitions – Clarify various terminology items;
- Section I.B – Discount and Convenience Ticket Programs – Clarify purpose of and eligibility for Toll Discount for Persons with Disabilities program, and identify new transit fare media available with new bus fareboxes;
- Section II.F – Exemptions from Tolls – Clarify procedure for receiving exemption in the toll lanes (last paragraph);
- Section III.B – Transit Zone Boundaries – Identify additional cities within the fare zones and add reference to extended bus service area across and east of the San Rafael-Richmond Bridge;
- Section III.C – Bus and Ferry Transit Cash Fare Tariff Schedule – Add reference to Medicare eligibility for cash fare discount;
- Section III.D – Discount Fares and Transfers – Identify new transit fare media available with new fareboxes, add reference to Medicare for cash fare discount, clarify internal transfer procedure, clarify fare-free provisions for transporting children age 5 and under, clarify procedure for attendants accompanying persons with disabilities receiving reduced fare, add reference to Sonoma Superpass;
- Section III.E – Regional Paratransit Tariff Schedule – Clarify eligibility for ADA regional paratransit service;
- Section III.F – Special Event Bus Service – Clarify purpose of service and add reference to new FTA charter bus rules;
- Section III.G – Special Event Ferry Service – Delete Bay to Breakers ferry service from this section, since the service has historically been operated as a supplement to regularly scheduled Larkspur-San Francisco ferry service, and apply regular fare policy.
